This is one of LinkCaring platforms together with its domains, subdomains, applications, and services available thereon, the "Platform" of LinkCaring Ltd ("LinkCaring", "we", "our", or "us"). This Privacy and Cookie Policy ("Privacy and Cookie Policy") describes our information practices in connection with the access and use of our Platform. 

 

LinkCaring is a technology company with an address at: Agur 18, Lehavim, Israel.

 

Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use available at (https://www.eng.linkcaring.com/terms-of-use), which this Privacy and Cookie Policy is incorporated thereto by reference.

 

LinkCaring reserves the right, in its sole discretion, to change this Privacy and Cookie Policy at any time. This change will take effect after the release of a revised Privacy and Cookie Policy on the Platform and your continued use of the Platform shall constitute acceptance of such changes. In such cases, LinkCaring will also update the "Last modified date" stated above. Please check the webpage above regularly for each change. 

Introduction

LinkCaring cares about your personal data and privacy interests. 

"Personal Data" means any information that refers to, is related to, or is associated with an identified or identifiable individual or as otherwise may be defined by applicable law.

That is why we take the issue of information security seriously. In this Privacy and Cookie Policy, we wish to explain to you how we collect your personal data, what its purposes and what are your rights.

Data security and privacy are an ongoing responsibility, and so we will from time to time update this Privacy Policy as we undertake new personal data practices or adopt new privacy policies.

LinkCaring is a Data Processor regarding the data collected in the Platform, and the data received from various medical databases. 

 

If you provide personal information to us about a third party, you must have obtained all necessary and lawful consents, approvals, and permissions of each such third party to do so and procure that each such third party agree and consent to all the terms of this Privacy and Cookie Policy.

Collection of Personal Information and consent 

We collect, process, and use your personal information for the purposes described in this Privacy and Cookie Policy, based at least on one of the following legal grounds:

 

  • With your consent: We ask for your consent to process your personal information for specific purposes, and you have the right to withdraw your consent at any time. For example, we ask for your consent to provide you with personalized content when you fill a contact form on the Platform. 

  • When performing this agreement: We collect and process your personal information to provide you personalized services with the Platform, following your acceptance of this Privacy and Cookie Policy; to maintain and improve our technology and platform; to develop new services and features for our Users, and to personalize the Platform for you to have a better user experience. 

  • Legitimate interests: We process your personal information for our legitimate interests while applying appropriate safeguards that protect your privacy. This means that we process your personal information for purposes such as detecting, preventing, or otherwise addressing fraud, abuse, security, usability, functionality or technical issues with our Platform, protecting against harm to the rights, property or safety of our properties, or our users, or the public as required or permitted by law; Enforcing legal claims, including investigation of potential violations of this Privacy and Cookie Policy; In order to comply and/or fulfill our obligation under applicable laws, regulation, guidelines, industry standards, and contractual requirements, legal process, subpoena or governmental request, as well as our Term of Use.

 

  • Clinical use: based on the data collected, our platform supplies services to support children and their families who need developmental and medical evaluation and treatment. Upon request, our platforms connect the children and families with professionals that are responsible for the child’s care. Relevant data will be shared with the child’s professional clinician. The collected data might include demographic and social data, health data including, pregnancy and delivery history, and family medical history, based on the relevant questionnaires. We technically label and tag each PII (personal identifiable information) and sensitive PII relating health information (AKA: PHI) furthermore, we store those types of data in separated databases.

 

  • Research: We collect and process personal data, as well as special categories of data, from various healthcare service providers to conduct research activities. Personal information collected via healthcare service provider and provided to LinkCaring pursuant to a specific license, which includes its own legal and operational terms. We will process this data as a Data Processor according to the agreement with those healthcare service providers and as authorized by law. 

 

For Israeli users, we collect, store, transfer or otherwise use your personal information only with your consent and in accordance with the terms of the Privacy and Cookies Policy (as applicable). You are not required by law to provide your personal information to LinkCaring or to a third party or to agree to all the terms of this Privacy and Cookies Policy. 

   

Third-Party Applications and Services

All use of third-party applications or services is at your own risk and subject to such third party's terms and privacy policies. 

 

Security and performance

We have implemented and maintained appropriate technical and organizational security measures, policies, and procedures designed to reduce the risk of accidental destruction or loss, or the unauthorized disclosure or access to Personal Data appropriate to the nature of such data. The measures we take include the physical, electronic, and procedural safeguards we employ to protect your Personal Data include secure servers, firewalls, antivirus, and SSL encryption of data. We maintain and regularly review and update our policies and procedures. We also limit access to your personal data to employees who will only process your personal data on our instructions, and they are subject to a duty of confidentiality. 

 

However, no method of transmission over the Internet or method of electronic storage is 100% secure.

Therefore, while we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. If you have concerns about certain personal information, you may wish to avoid passing that information over the Internet.

 

What are your rights?

 Under applicable data protection laws, you have several important rights free of charge. In        summary, those include rights to:

  • The right to access, update or delete the personal information we have on you.

  • The right of rectification.

  • The right to object.

  • The right of restriction.

  • The right to data portability

  • The right to withdraw consent.

  • Right to Lodge a Complaint with Your Local Supervisory Authority. 

  • Right to Object to processing. 

 

If you would like to exercise any of those rights, please contact us using the details of our DPO provided above and specify the personal information to which your request relates. 

We may need to request specific personal information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We try to respond to all legitimate requests within one month and in accordance with applicable law. Occasionally, subject to applicable law, it could take us longer than a month if your request is particularly complex or you have made several requests (in which case we will notify you and keep you updated).

There are some exceptions to the rights listed above and, although we will always try to respond to any instructions you may give us about our handling of your personal information, there may be situations where we are unable to meet your requirements in full.

 

When and how do we share personal information with others?

LinkCaring does not store the Platform on its own infrastructure and any storage is supplied by AZURE (Microsoft), a third party that provides storage services. This means that the data you provide to LinkCaring or that LinkCaring or third parties collect from you (including any personal information) is stored by third-party service providers on servers owned or controlled by them. Their servers are located in Europe.

Therefore, please note that you agree that your data will be transferred to various third-party service providers worldwide. LinkCaring relies on the security and privacy declarations and statements of the service provider regarding the infrastructure.  

 

We will only disclose your personal data to third parties when:

  • You have given your consent. 

  • It is legally permissible and required for the performance of a contract to which you are party to it.

  • Disclosure of personal data is necessary for compliance with a legal obligation.

  • Disclosure of personal data is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

  • We will notify you if your personal data is to be disclosed due to specific circumstances in an individual case.

  • Service Providers, and Subcontractors. We also disclose information, including Personal Data we collect from and/or about you, to our trusted third-party service providers and subcontractors, who have agreed to confidentiality restrictions and who use such information solely on our behalf in order to: (1) help us provide you with the Platform, and/or our services; (2) aid in their understanding of how users are using our Platform, and/or services; 

    • Such service providers and subcontractors provide us with IT and system administration services, data backup, security, and storage services, web hosting and data analysis.

  • Law Enforcement Related Disclosure. We may share your Personal Data with third parties: (1) if we believe in good faith that disclosure is appropriate to protect our or a third party's rights, property or safety (including the enforcement of the Terms and this Privacy Notice); (2) when required by law, regulation subpoena, court order or other law enforcement related issues, agencies and/or authorities; or (3) as is necessary to comply with any legal and/or regulatory obligation.

 

International Transfer

We use subcontractors and cooperate with healthcare service providers and have affiliates who are in countries other than your own, such as Israel or other countries in the EEA, and out of EEA and may share with them personal information we receive (including Personal Data). We conduct such international transfers for the purposes described above and in accordance with applicable law. We will ensure that these third parties will be subject to written agreements ensuring the same level of privacy and data protection as set forth in this Privacy and Cookie Policy, including appropriate remedies in the event of the violation of your data protection rights in such a third country. Whenever we transfer your Personal Data to third parties, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented: 

  • We will only transfer your Personal Data to countries that have been deemed to provide an adequate level of protection for Personal Data by the European Commission, and further to Article 45 of the UK GDPR, including Israel. 

  • There are appropriate safeguards in place, together with enforceable rights and effective legal remedies for you, or a specific exception applies under relevant data protection law.

 

Please contact our DPO if you would like further information on the specific mechanism used by us when transferring your Personal Data out of the borders of Israel or EEA. 

 

Data storage and retention

Subject to applicable law, we retain Personal Data as necessary for the purposes set forth above. We may delete personal information from our systems without notice to you once we deem it is no longer necessary for these purposes. In some circumstances, we may store your personal Data for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, audit, accounting or research requirements and so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your Personal Data or dealings. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data, and whether those purposes can be achieved through other means, as well as applicable legal requirements.

We do not offer our services to children under the age of 18 or knowingly collect any personal information from users under the age of 18 without first obtaining consent from their parents or guardians.
